These Terms & Conditions ("Terms") govern your access to and use of the Kraken service, the hirekraken.com website, and related software and services (the "Service"), operated by HireKraken.com, a subsidiary of Cuevanomics.com ("Kraken," "we," "us"). By creating an account, purchasing, or using the Service, you ("Customer," "you") agree to these Terms.
Kraken is an AI-assisted outbound sales and lead-generation service. We source prospect lists, generate and send outreach on your behalf from sending accounts, and surface responses for you to act on. The Service is provided as a tool; outcomes depend on many factors and we do not guarantee any specific results.
You must be at least 18 and authorized to bind your business. You are responsible for the accuracy of your account information and for all activity under your account.
Fees include a one-time setup fee, a monthly platform access fee, and per-lane subscription fees, as presented to you at purchase. Deposits reserve a build slot and are applied to your setup. Setup fees and deposits are non-refundable once onboarding begins. Subscriptions renew each 30-day term until cancelled; higher-volume tiers may carry a stated minimum commitment. Prepaid terms are non-refundable. You authorize us and our payment processor to charge your payment method for all fees due.
You are solely responsible for your campaigns and for compliance with all applicable laws and regulations, including the CAN-SPAM Act, TCPA, CASL, GDPR, and CCPA. You represent and warrant that you have the right to contact the prospects targeted, that your offers and content are lawful and not misleading, and that you will honor opt-out and unsubscribe requests. You will not use the Service to send unlawful, deceptive, harassing, or infringing content, or to target individuals without a lawful basis. We may suspend the Service for conduct that threatens deliverability, violates law, or breaches these Terms.
Any projections, estimates, or examples (including lead, meeting, or revenue figures) are illustrative only, are not promises, and will vary. Email deliverability and response rates depend on factors outside our control.
We own the Service, software, and all related intellectual property. You own the customer data and lead lists you provide. You grant us a limited license to process that data to operate the Service for you.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or revenue. Our total liability for any claim is limited to the fees you paid to us in the three (3) months preceding the event giving rise to the claim.
You will indemnify and hold harmless Kraken, HireKraken.com, and Cuevanomics.com from any claims, damages, or costs arising from your use of the Service, your content, your data, or your violation of law or these Terms.
Either party may terminate as provided in your plan. We may suspend or terminate for non-payment or breach. Fees accrued and minimum commitments survive termination.
These Terms are governed by the laws of the State of Texas, and disputes will be resolved in the state or federal courts located in Harris County, Texas.
We may update these Terms; material changes will be posted here with an updated date. Continued use means you accept the changes.
